BenQ Europe B.V. (“We”, “Us”, “Our”) is committed to protecting and respecting your privacy, In this statement, we will explain to you:

  1. Why we need to process your personal data
  2. What type of personal data we process
  3. How we use your personal data,
  4. Your rights, and
  5. Quesions and complaints

1. Why we need to process your personal data

We process your personal data for the following purposes:

  • To contact winners for handing out the prizes
  • To communicate for the use, publication and follow-ups about the winning works

In other situations, it will be necessary for us to process your personal data to comply with the legal obligations imposed on us, to protect vital interests of you or another natural person, to perform a task carried out in the public interest or in the exercise of official authority vested in us.

2. What types of your personal data do we process?

We process the following personal information:

  • Your E-mail address
  • Your social media account information which you have made public or provided to us for the purpose above
  • Your delivery information such as address, phone number.

The provision of personal data is required for the above purposes. In other words, if we cannot obtain your personal data from you, we may not be able to fulfil the purposes above.

We do not process any special categories of personal data. If we are required to do so, we will process such personal data of you in accordacne with relevant regulations, including but not limtied to Article 9 of the General Data Protection Regulations.

In any case where the image, likeness, name, and voice of any natural person that appear in your work, you are responsible for obtaining the necessary consent legally required, release and discharge of liability, and license to use the data subject’s information. We reserve the right to ask you to demonstrate the legal basis for the processing.

3. How we use your personal data

Your personal data will be kept with our marketing campaign team. We do not store your personal data longer than strictly necessary in order to achieve the purposes for which your data are collected.

We transfer personal data within our group for internal administrative purposes and as necessary to fulfil the purposes. As a result, it may be necessary to transfer your personal data to parties that are established outside the country of your residence. In that case, we will only transfer your personal data to external parties if it is guaranteed that the security of the data is at least equivalent to the security that we maintain. We also use a variety of legal mechanisms to help ensure that your rights and protections will travel with your data, including implementing the Standard Contractual Clauses approved by relevant regulatory bodies.

Your personal data may be provided to third parties only if it is compatible with the purpose or purposes for which the data are collected. We enter into a processing agreement with companies processing your personal data on our behalf, in order to ensure a same level of security and confidentiality of your data. We remain,

however, responsible for the processing.

We take the protection of your personal data very seriously and undertake every effort to prevent misuse, loss, unauthorised access, undesirable disclosure and unauthorised modification as much as possible. We ensure that access to personal data is limited to those who are charged with the execution of the activities in the context of which the personal data have been or will be processed

If we become aware of a breach of security resulting in adverse consequences for the protection of personal data or a significant chance of such adverse consequences, we will notify the competent authority as soon as possible. If the breach is likely to result in a high risk to have an adverse effect on you personally, we will notify you as well of this.

4. Your rights

Under the privacy regulations, you may:

  • Access your personal data (right of access);
  • Correct or have corrected your personal data (right to rectification);
  • Erase or have erased your personal data (right to be forgotten);
  • Object against our processing of personal data (right to object);
  • Restrict our processing of your personal data (right to restriction of processing);
  • Have us transfer your data to you or to a third party to be designated by you (right to data portability);
  • Withdraw your consent, if any, for the data processing (this, however, does not mean that the personal data that were processed prior to this withdrawal are no longer validly processed);

You may exercise your right by sending a request to us. To ensure that a request has been actually made by you, we will ask you to send us a copy of your identity card (passport, identity card or driver’s licence). Please blacken your photo, the MRZ (‘machine readable zone’, the strip with numbers on your identity card), the document number and the citizen service number.

5. Questions and Complaints

We will be pleased to help you find a solution. If the response is unsatisfactory, you may always lodge a complaint to the national supervisor, the Dutch Data Protection Authority.
