2. Personal Data
If the generated data constitutes or includes personal data, we will make personal data available only when there is a valid legal basis under Article 6 of Regulation (EU) 2016/679 (GDPR) and only, where relevant, the conditions set out in Article 9 of that Regulation and of Article 5(3) of Directive 2002/58/EC (Directive on privacy and electronic communications) are met.
3. Data Sharing Request
Where you choose to authorize a third party (a “Data Recipient”) to receive, access, and transfer the data concerning your use of a BenQ Device or Related Service(s), you can submit a request to us and specify the relevant contact details of the Data Recipient. Only Data Recipients located in the EEA are eligible. A signed agreement with the Data Recipient is a prerequisite for the commencement of the data sharing process.
4. Agreement on Access and Use of Data
To comply with the EU Data Act and ensure the continued provision of our services, it is necessary to implement a contract regarding access to and use of data by the Users and the Data Recipients. The contract will govern the data access and use by Users of the eligible BenQ Devices and Related Service(s) and/or the Data Recipients. Please contact us to receive a copy.
